Home > Terms & conditions Refrigerated Products are shipped using Sorba Freeze (http://www.sorba-freeze.com) Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control. Should you fail to be present for your delivery we are entitled to charge you in full for an amount equal to the price of perishable items contained in your order and the cost of delivery. Returns We guarantee the quality of our goods. You must inspect the goods and notify us promptly in writing, by phoning us or by an e-mail of any defects. We will promptly and fully refund the price of any goods that do not meet with your reasonable satisfaction or arrange for the delivery of replacement goods, provided that you notify us within 7 days of delivery of the goods. This excludes the cost of any delivery charge if the goods have been successfully delivered. We will arrange with you for the goods to be returned to us in good condition and within a maximum of 10 days. Your statutory rights are not affected. Cancellation You can cancel or change any of your current orders up until 17:00pm 2 working days before delivery, Monday to Saturday. You can do this by calling our Customer Services department on 020 3713 8953. Please note that orders cannot be cancelled by email. Security Policy & Information 1chef4u use SagePay, to process our online debit and credit card payments. SagePay are an internationally respected Internet Payment Service Provider. They provide the software to enable our website to take secure online credit and debit card payments. 1chef4u does not store any of your debit or credit card details on our databases. 3D Secure 3-D Secure was developed by Visa® and Mastercard® to guard you against unauthorised use of your card while shopping online with participating merchants. It works on the same principle as chip and pin and once enrolled you’ll have the added confidence knowing that MasterCard SecureCode® or Verified by Visa® performs an extra authentication step to protect your account from unauthorised users online. How Does It Work? If your card issuer is part of the scheme, you will be asked to enroll once you get to the checkout stage on our website. You will be passed over to a page on your card issuer’s website by a secure link to create a password. This communication is secure and is between you and your card issuer, your information is never shared with the merchant. Once you have enrolled and chosen your personal secure code with your card issuer you will never have to register your card again. Instead, every time you shop online with a participating online merchant the MasterCard SecureCode® or Verified by Visa® window will automatically open and ask for your secure code just like you would be asked to input your pin number in a store. Once you have entered your SecureCode your identity is confirmed with your card issuer and your purchase is completed. Since the introduction of 3D Secure card fraud has dropped considerably so register now to safeguard your card and give you peace of mind when ordering online. SagePay transaction security The transfer of your details from mrduck to SagePay is encrypted and digitally-signed. This ensures that the information passed is secure and tamper-proof. SagePay Security for the customer Any communication between the customer and SagePay is encrypted to the maximum strength supported by the customer’s browser. The customer is also protected from fraudulent use of their card in a “card not present” environment, by their card issuer. How does SagePay verify credit card information? SagePay validates your credit card by checking the details you entered on the mrduck payment page. This includes your billing name and address; this should be as it appears on your credit card statement. SagePay also check the Card Verification Value (CV2), this is the additional 3 or 4 digit security code found on the signature strip on the back of your card. SagePay data storage All data stored on SagePay’s systems is held on encrypted and highly secured databases. SagePay are regularly audited by Visa and MasterCard to ensure that their systems conform to the latest security standards. When is my card charged? We charge your debit or credit card on placing your order. Which credit cards do you accept? We accept Visa and MasterCard credit cards. We also accept debit cards with the Visa, MasterCard, Maestro and Solo logo and International credit cards. We can only accept, at present, billing addresses within the EU . We do not accept personal cheque. Website Terms and Conditions mrduck.co.uk Product Terms and Conditions 1. Prices With the exception of goods referred to in clause 1.1(b), the price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the “checkout” button) subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged will be those applicable to the new item(s) at the time that the amended order is confirmed. Where a substitute item is offered in place of an item ordered, the price charged for that substitute item (if accepted) will be the price applicable at the time the item is substituted 1.1b Where items are ordered and sold individually by weight (such as certain fresh meat, poultry, fish, cheese or fruit and vegetables) the price of these items (expressed per kilogram or other appropriate unit of measurement) will be the price on the date that they are weighed. Although we have an indicative weight guide on the website, this is merely to assist your planning and the price you will be charged is the price for the actual weight you receive. In the event that there is a change in the price/kg between the time your order is made and the time the item is weighed and priced, the price you will be charged will be the price at the time the item is weighed. When your order is delivered you may return any item and receive a full refund if you consider that the difference between the price charged and the price shown on the website is unacceptable. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the Delivery charge which will be charged at the rates applicable. It will be displayed in the ‘Shipping Policy’ section of the web site. 2. Availability If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Please note that we will attempt to deliver substitute lines, should selected lines be unavailable, unless you request us not to do so. We may limit the quantities of goods (particularly goods on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardises availability for other customers. 3. Acceptance There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods. 4. Delivery Delivery will be made to the address specified by you on the completed order form. We will deliver your order to the main entrance of the delivery address. At your request, our driver may carry your order into the delivery address, for example, to a particular floor in an apartment block or into your kitchen but only if: a. the driver has your permission and b. our driver believes that it is safe and practical to do as you request. We always reserve the right to deliver only to the main entrance of the delivery address. Please note that we deliver goods only to specified regions within the United Kingdom . To check that the online Grocery service delivers to your area, please check on the shipping policy page. There is a minimum order requirement of £15 on any order calculated at the time of ordering. Delivery times will be agreed with you at the time of placing your order. We will promptly and fully refund the price of any goods that do not meet with your reasonable satisfaction or arrange for the delivery of replacement goods, provided that you notify us within 7 days of delivery of the goods. We will arrange with you for the goods to be returned to us. Your statutory rights are not affected. 5. Cancellation You can cancel or change any of your current orders up until 17:00pm 2 working days before delivery, Monday to Saturday. You can do this using the “Your orders” option on the mrduck.co.uk site, or you can call our Customer Services department on. Please note that orders cannot be cancelled by email. 6. Payment You can pay by any MasterCard or Visa credit card, Maestro or Delta debit card. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of placing your order. Our liability to you in connection with any order will not exceed the total price charged for the relevant items. We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology. This means you cannot inadvertently place an order through an unsecured connection. 7. General These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law. Customer Services These Terms and Conditions govern your use of the mrduck.com and .co.uk website and your relationship with MrDuck (Mrduck, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the mrduck.co.uk Site. 1. Use of the mrduck.co.uk Site The 1chef4u.com Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the mrduck.co.uk Site you agree to be bound by these Terms and Conditions. Registration To register with 1chef4u.com you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. Password and security When you register to use the 1chef4u.com Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services (see below for contact details) immediately. If mrduck.co.uk has reason to believe that there is likely to be a breach of security or misuse of the mrduck.co.uk Site, we may require you to change your password or we may suspend your account. 4. Standard Coupon Terms and Conditions 4.1 Using Coupons Coupons can only be used online at mrduck.co.uk subject to these general terms and conditions, and any other specific conditions notified to you on the issue of a Coupon. A Coupon is redeemed by entering its code at the appropriate point in the online purchase process. Redemption may be subject to you providing proof of entitlement to use the Coupon. Your use of a Coupon indicates your agreement to be bound by these Coupon Terms and Conditions. 1chef4u reserves the right to withdraw or cancel a Coupon for any reason at any time. 4.2 Distribution of Coupon Coupons are, and remain at all times, the property of Mrduck ltd The right to use a Coupon is personal to the original recipient and may not be transferred. No Coupon may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without the prior written permission of MrDuck Ltd. Coupons distributed or circulated without the written approval of MrDuck Ltd, for example on an Internet message board or on a “bargains” website, are not valid for use and may be refused or cancelled. 4.3 Permitted usage of Coupons Unless expressly stated otherwise at the time of issue of the Coupon; Each issued Coupon will be valid for use by a recipient only once, Only one Coupon will be valid for use per customer or household, as the case may be, and, A Coupon may not be used in conjunction with any other special offer or Coupon. Coupons cannot be exchanged for cash or used to purchase gift-vouchers. 4.4 Excluded goods and services Certain goods or services are excluded from all Coupon offers. From time to time other goods or services may be excluded and any such further exclusion will be notified to you along with the Coupon or through the mrduck.co.uk website. Coupons may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the Coupon, in which case notice will be given to you at the time of issue of the Coupon. Excluded goods and services will not count towards any qualifying conditions for offers and will not benefit from any promotional discount. Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage. Supplementary charges such as delivery or postage & packing shall not be discounted unless specifically stated in the offer description. 4.5 Security and Fraud When you use a Coupon you warrant to MrDuck Ltd that you are the duly authorised recipient of the Coupon and that you are using it in good faith. If you redeem, attempt to redeem or encourage the redemption of Coupons to obtain discounts to which you or a third party are not entitled you may be committing a civil or criminal offence. If we reasonably believe that any Coupon is being used unlawfully or illegally we may reject or cancel any Coupon and you agree that you will have no claim against us in respect of any rejection or cancellation. mrduck reserves the right to take any further action it deems appropriate in such instances. If we refuse a Coupon submitted as part of an order, for any reason, we will inform you before the order is dispatched to advise of the correct cost of the order and give you the opportunity to cancel the order. 4.6 Limitation of liability At all times our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order. All offers are subject to availability and while stocks last. MrDuck shall not be liable to any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any Coupon or any failure or inability of a customer or household to use an e-Coupon for any reason. 4.7 Miscellaneous We reserve the right to vary or terminate the operation of any Coupon at any time without notice. The failure of 1chef4u to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Refunds on promotional offers Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected. 5. Excluded Services The services provided by the mrduck.co.uk Site do not include the provision of computer or other necessary equipment to access the mrduck.co.uk Site. To use the mrduck.co.uk site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur. 6. Intellectual property The content of the 1chef4u.com Site is protected by copyright, trade marks, database and other intellectual property rights. Applicable Law These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts. 12. Miscellaneous You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and mrduck.co.uk ignores this, mrduck.co.uk will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. 1chef4u.com shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
